Landlords Legionella Risk Assessment

Meet your legal duty with a fully documented,
L8-compliant risk assessment for your rental property.

Do Landlords Need a Legionella Risk Assessment?

Yes. Under HSG274, landlords have a legal duty to assess and manage the risk of Legionella bacteria in all residential rental properties, regardless of size or type.

That doesn’t mean every property needs water testing. It means every property needs a competent person to assess the risk, document their findings, and recommend control measures where necessary. That documented assessment is what protects you as a landlord.

At H2O Comply, we conduct landlord Legionella risk assessments that are fully compliant with L8 and HSG274 guidelines, providing you with the paperwork, peace of mind, and evidence of due diligence.

What Are Your Responsibilities as a Landlord?

You don’t have to be a health and safety expert, but you do need to take reasonable steps to manage the risk of Legionella.

Your landlord water responsibilities include:

âś… Identifying potential Legionella risks in water systems

âś… Arranging a Legionella risk assessment (especially for new tenancies)

âś… Taking steps to reduce or remove risks (e.g. flushing systems, adjusting water temps)

âś… Keeping records of the assessment and any action taken

âś… Reviewing the risk assessment regularly, especially after changes to the system or occupancy

A professional landlord Legionella risk assessment is the most straightforward way to meet all of these obligations in one visit.

Landlords must ensure that the water supply is safe for tenants. A professional Legionella risk assessment is the most effective way to meet your legal obligations.

Why Choose H2O Comply

Why Landlords Must Take Legionella Seriously

Legionella bacteria can cause Legionnaires’ disease, a potentially fatal form of pneumonia. It thrives in stagnant or warm water systems—often found in domestic rental properties, especially those left vacant for even short periods.

The Health and Safety Executive (HSE) has confirmed that landlords have a legal duty to assess the risk of Legionella exposure in all residential lettings—regardless of property size.

Landlord Legionella Risk Assessment — Frequently Asked Questions

Is a landlords Legionella risk assessment a legal requirement? Yes. The HSE confirms that landlords have a legal duty to assess Legionella risk in all residential lettings. The duty is to assess — not necessarily to test. Whether water sampling is needed depends on what the assessment finds.

What’s the difference between a risk assessment and a water test? A risk assessment is a formal evaluation of your water systems carried out by a competent person. It identifies whether conditions exist that could allow Legionella to grow. Water testing involves taking samples to check for the presence of bacteria. Testing is carried out where the assessment identifies a potential risk, not as a substitute for it.

How often do I need a Legionella risk assessment? Every two years is the general recommendation. You should also commission a new assessment when a new tenant moves in, after significant plumbing work, or if a property has been vacant for an extended period.

Do I need an assessment for each property? Yes. Each property has its own water system and its own risk profile. A single assessment cannot cover multiple addresses.

Will I receive a certificate? You’ll receive a full written L8 risk assessment report, which you can keep on file as evidence that you’ve met your legal duty.

How long does an assessment take? Most residential properties can be assessed in under an hour. You’ll receive your written report shortly after.
